Terms of Service
These terms govern business use of the 100 Rocks storefront analytics, adaptive interface testing, design-token, and Ask AI platform operated by Karen Charykov, Entrepreneur individuel (EI). The Data Processing Addendum (DPA) forms part of these Terms when we process storefront visitor personal data for you.
Agreement
By creating a 100 Rocks account, subscribing, installing the storefront tracker, activating the Shopify app, or using the merchant console at get.100.rocks or through Shopify Admin, you agree to these Terms of Service (Terms) for the business you represent. If you do not agree, do not use the service.
Business customers only
The service is offered only to companies, entrepreneurs, and other persons acting for professional or commercial purposes. You confirm that you are at least 18 years old and authorized to bind that business. The service is not offered for personal or consumer use.
Service description
100 Rocks provides storefront analytics, consent-gated behavior measurement, session metrics, heatmaps, merchant-approved PDP variant testing, adaptive interface serving, design-token tooling, and Ask AI banner and copy-autofill features for supported stores. Features and usage allowances depend on the product plan shown in the service or at checkout. We may improve, replace, or discontinue features, but material changes to a paid plan take effect no earlier than the next renewal unless required for security or law.
Accounts and customer responsibilities
You must provide accurate account information, protect credentials, and promptly notify us of unauthorized access. You are responsible for authorized users, your storefront, your instructions, your Shopify or other platform account, and compliance with applicable commerce, privacy, and electronic-communications laws. When you activate the Shopify app, you authorize us to initialize or enrich a 100 Rocks account using the store contact email supplied by Shopify. A verified Shopify session authorizes embedded, shop-scoped access; standalone console access requires email verification. You confirm that you own or are authorized to use submitted storefront content and assets. You must not provide payment-card data, customer-account data, free-text form contents, or other unnecessary sensitive data to analytics or design-scan features.
Plans and usage allowances
Plan prices, billing periods, included usage, and restrictions are shown before purchase. For 100 Rocks Optimization, Free includes up to 3,000 measured sessions per store per UTC calendar month and one lifetime design extraction per Free store. Session 3,001 requires Starter. Starter includes up to 60,000 total measured sessions per store per UTC calendar month, including Free usage before a mid-month upgrade, and up to ten design extractions per store per UTC calendar month. Session 60,001 pauses new analytics collection and adaptive serving until the next UTC-month reset; the approved default variant remains available. Stripe-billed Starter costs EUR 50 per month or EUR 450 per year. Shopify-billed Starter costs USD 50 per month or USD 450 per year. Ask AI is a separate product subscription. Ask AI Explorer is free and includes up to 1,000 banner sessions and 10 copy-autofill pages per store per UTC calendar month. Ask AI Starter costs EUR 10 per month or EUR 100 per year and includes up to 100,000 banner sessions and 100 copy-autofill pages per UTC calendar month. Ask AI Pro costs EUR 100 per month or EUR 1,000 per year and includes up to 1,000,000 banner sessions and 1,000 copy-autofill pages per UTC calendar month. Prices exclude applicable taxes unless checkout states otherwise. We do not charge an unannounced overage.
Billing, renewal, and cancellation
Paid 100 Rocks Optimization and Ask AI subscriptions are charged in advance through the billing provider shown at checkout and renew automatically until cancelled. They are independent subscriptions: buying, changing, failing to pay for, or cancelling one product does not change the other product's subscription or entitlement. Direct-console and custom-site subscriptions are billed by Stripe. A store installed through the production Shopify App Store app is billed only by Shopify and remains assigned to Shopify billing after uninstall or reinstall. Fees exclude applicable taxes unless stated otherwise. If payment fails or remains overdue, the provider may retry it and we may suspend access to the affected paid product. You may cancel or manage each subscription through the billing surface shown in the service, which shows when cancellation takes effect. Fees already charged are non-refundable except where mandatory law requires or we expressly grant a refund or credit. We notify affected customers before a price change applies to a future renewal. French business late-payment rules may add penalties at three times the statutory interest rate and the statutory EUR 40 recovery indemnity.
Acceptable use
You may not use 100 Rocks to collect data without a lawful basis or valid consent where required; access another customer's data; circumvent usage, security, or access controls; upload malicious code; resell the service without permission; or use the service unlawfully. You are responsible for your storefront privacy notice and consent configuration.
Merchant data and privacy
For storefront visitor analytics, you are the controller and 100 Rocks (Karen Charykov, Entrepreneur individuel (EI)) is the processor. Processing is governed by our Data Processing Addendum, which an authorized merchant accepts when creating or connecting a store. Shopify activation evidence records the store, app and installation epoch, accepting Shopify identity, policy versions, attestations, and timestamp. You warrant that required notices and consent controls are active before behavior-capable analytics runs. Our Privacy Policy covers account data for which we act as controller.
Customer content and licence
You retain rights in content and assets you provide and grant us a non-exclusive licence to host, copy, analyze, and transform them only as needed to provide, secure, and support the service. 100 Rocks retains rights in the platform, methods, reusable templates, and branding. Subject to applicable fees, you receive a perpetual, non-exclusive right to use, modify, and export outputs created specifically for your store; this does not transfer our platform, methods, or reusable components.
Confidentiality
Each party will protect the other's non-public business, technical, and security information using reasonable care and use it only for the service relationship. This excludes information that is public without breach, already lawfully known, independently developed, or lawfully received from another source. Disclosure required by law is permitted with notice when legally allowed.
Disclaimer and warranties
The service is provided as is and as available to the extent permitted by law. 100 Rocks does not promise a particular commerce result, uninterrupted availability, or error-free analytics. Third-party services, storefront platforms, browsers, consent tools, and networks may affect availability and results.
Limitation of liability
To the maximum extent permitted by law, neither party is liable for indirect or consequential loss, lost profit, revenue, or goodwill. 100 Rocks's total liability is limited to fees paid for the affected store during the twelve months before the event. Limits do not apply to fraud, intentional misconduct, gross negligence, death or personal injury caused by negligence, confidentiality or intellectual-property breaches, unpaid fees, or liability that law does not permit the parties to limit.
Governing law
These Terms are governed by French law. After a good-faith attempt to resolve a dispute, the courts of Paris, France have exclusive jurisdiction unless mandatory law requires another forum.
Changes to these Terms
We may update these Terms. We update the policy version and date and notify affected customers before a material change applies to an existing paid subscription. If you do not accept it, you may cancel before it takes effect. Changes required by law or security may apply sooner.
Suspension and termination
We may suspend or limit access for non-payment, breach, unlawful or abusive use, quota enforcement, or a security risk. You may stop using Free at any time and cancel Starter through the applicable billing surface. Export needed data before deleting a store or account. Storefront visitor data follows the DPA; account and billing records follow the Privacy Policy. Payment, confidentiality, intellectual property, liability, and dispute terms survive where their nature requires.
General
Neither party is liable for delay beyond its reasonable control. Assignment requires consent except with a relevant business sale or by operation of law. Notices may be sent to the account email or help@100.rocks. Failure to enforce is not a waiver; unenforceable terms are severed. These Terms, the DPA, and plan and checkout terms form the entire agreement. The DPA controls its subject matter, checkout terms control price and billing-period details, and these Terms control otherwise.
